1. Consumer Guarantees & Fair Trading These terms operate alongside, and do not override, your statutory rights under the New Zealand Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986.
2. Pricing and Currency All prices displayed on our retail and e-commerce websites are listed in New Zealand Dollars (NZD) unless explicitly stated otherwise. Prices include Goods and Services Tax (GST) unless explicitly stated otherwise. We reserve the right to modify pricing at any time without prior notice.
3. Ordering and Acceptance An order placement via our checkout or parts request channels constitutes an offer to purchase. We reserve the right to accept or decline any order for reasons including product unavailability, pricing errors, or suspected unauthorized transaction activity. If an order is canceled after payment has been processed, we will issue a full refund to your original payment method immediately.
4. Logistics & Delivery We coordinate logistics directly from our New Zealand and international facilities to get your machinery, parts, and gear operational and ready for the field. Delivery timeframes provided are estimates only. We are not liable for external shipping or freight delays, but we will assist in tracking and resolving delivery issues where possible.
5. Returns, Faults, and Refunds Faulty Items: If a product, part, or accessory is faulty, damaged, or does not match the description provided, we will fulfill our legal obligations under the CGA by repairing it, replacing it, or providing a full refund. Change of Mind: We are not legally required to provide a refund or replacement if you simply change your mind, choose the wrong size, or decide you no longer want a product. Any exchanges for change of mind are at our sole discretion.
6. Limitation of LiabilityTo the maximum extent permitted by New Zealand law, DC Equipment and its respective brands shall not be liable for any indirect,incidental, or consequential damages resulting from the use of our products,machinery, or the inability to use our digital platforms.
7. Governing Law These terms are governed by and construed in accordance withthe laws of New Zealand. Any disputes arising out of the use of our sites orour services will be subject to the exclusive jurisdiction of the New Zealand courts.
